Nikah contract terms are the parts of the marriage agreement that should be clear before anyone says qubool. Families argue later about money, housing and “what we meant” because they treated the nikahnama as calligraphy instead of a contract.

Ijab and qabul
Offer and acceptance must be clear, in a language the relevant parties understand, in the manner your school requires. Repeating a phrase as a performance is not the same as knowing what you accepted. Read what is nikah.
Mahr (mehr)
Mahr is the bride’s right—prompt, deferred, or mixed. Write:
- What (cash, gold, property—be specific).
- When the prompt portion is paid.
- When deferred mahr becomes due (often on death or divorce, but write what you actually agreed).
It is not a fee to parents. It is not the walima bill. Inflating a number for status and never intending to pay is a form of dishonesty.
Witnesses
Sunni practice generally requires witnesses whose testimony can be relied on. Ask how many, of which gender mix, and whether they must hear the words. Do not grab two random cousins from the buffet line at the last second.
The wali
Where a wali is required, name who is acting and that the bride’s permission was sought. See role of the wali.
Optional conditions
Some couples mention residence, work, or that a second marriage needs her knowledge. Whether a condition is valid, void, or disliked is a fiqh question. Do not copy a Pinterest list onto a legal-looking page without a scholar.
Unfair conditions (“you may never see your parents”) are not piety.
What to put on paper the same day
- Full names as on ID.
- Date and place.
- Mahr schedule.
- Officiant and witness names.
- Copies for both spouses.

Can we keep mahr “secret”?
Privacy from gossip is fine. Secrecy from the bride is not. She should know her own entitlement.
What if we forgot to name mahr?
Do not announce the marriage invalid on WhatsApp. Ask a scholar. For a marriage you are still planning, name it.
